The site https://www.keenonyoga.com/ hereinafter referred to as the “Site”) is an information and electronic commerce site accessible through the Internet, open to any user of this network (hereinafter referred to as “Internet user” ). It is edited by the company Keen on Yoga (hereinafter referred to as “Keen on Yoga”), SAS with a capital of 500 Euros, whose head office is located at 6 Rue de la Roquette, 13200, Arles.
The Site allows Keen on Yoga to offer for sale online content including livestream online Ashtanga yoga classes, various online teachings, including through direct instruction, written work, images and videos on a subscription or ad-hoc basis as well as yoga related products. (hereinafter referred to as the “Products and Services”) to Internet users browsing the Site (hereinafter referred to as “Users”). The User who has validated an order will be referred to as “Customer”. The rights and obligations of the User necessarily apply to the Customer.
Any order for a Product or Service offered on the Site implies consultation and express acceptance of these general conditions of sale and withdrawal, manifested by ticking the box “I declare that I have read and accepted the general conditions of sale for Keen on Yoga and am informed of my right of withdrawal. “.
ARTICLE 1: OBJECT
The purpose of these general conditions of sale is to define, exclusively, on the basis of the relationships that they establish on the Internet network, the rights and obligations of the Parties arising from the online sale of the Products and Services offered on the Site.
They regulate all the steps necessary for placing the order and ensure the follow-up of this order between the Parties.
The present conditions apply to the exclusion of any other document.
ARTICLE 2 – PRODUCTS & SERVICES
2.1 Products & Services
The Products & Services offered for sale by Keen on Yoga are those which appear on the Site, on the day of consultation of the Site by the User and within the limits of available stocks.
In case of unavailability of one of the Products, the customer will be informed as quickly as possible.
The photographs and texts illustrating the Products do not enter into the contractual field.
ARTICLE 3 – PRICE
The prices are indicated in Euros and are valid for the territories of the European Union except DOM and TOM. They take into account any reductions as well as French VAT, applicable on the day of the order.
Any order placed on the Site and delivered outside the European Union and to the French overseas departments and territories will be invoiced without VAT and may be subject to any taxes, customs duties and other related costs which are imposed when the package reaches its destination. These additional costs are the responsibility of the Customer and are their responsibility.
The prices indicated on the Site are guaranteed on the day of the order within the limits of available stocks, and except for manifest typographical errors or omissions.
The prices indicated do not take into account the shipping costs (where applicable) which will be invoiced in addition or offered depending on the amount of the order and the country of delivery, and will be specified to the User during the final validation of his order. These shipping costs do not include customs and other additional costs that may be requested when entering certain countries, these costs remain the sole responsibility of the customer.
Keen on Yoga reserves the right, which the User accepts, to modify its prices at any time.
ARTICLE 4 – ORDER REGISTRATION AND VALIDATION
4.1 Navigation within the Site
The User can find out about the different Products and Services offered for sale by Keen on Yoga on its Site. The User can browse freely on the various pages of the Site without being committed to an order.
4.2 Registration of an order
If the User wishes to place an order, they will choose the different Products in which they have an interest, and will click on the Buy Now or Join Now button.
To order the chosen Products chosen, all Users must identify themselves, by entering their e-mail address and the password that they have previously chosen during the checkout previously or, if it is their first order, by clicking on “Create my account” and accurately completing the form with the information necessary for their identification, particularly including their surname, first name, postal address, e-mail address and a password of their choice which will be personal and confidential and which will be needed to identify themselves subsequently on the Site.
The User is informed and accepts that entering these two identifiers constitutes proof of his identity and manifests his consent.
Discounts & special offers
To benefit from a discount or special offer that has been sent to them, the User must enter and validate their code in the field provided.
4.3 Final validation of the order and payment
After having read the status of his order, and once all the requested information has been completed by the User, a summary of this information and the order will appear and the latter must choose the payment method with which they wish use to definitively confirm their order.
Orders are payable in:

It is specified that by making an immediate payment by bank card, the User will then be automatically switched to the electronic payment server of the secure payment platform. This platform is secured by SSL (Secure Socket Layer) encryption in order to protect all data related to means of payment, and that at no time will the User’s banking data pass through the computer system from Keen on Yoga
As soon as they validates their payment, the order is registered. The User becomes a Customer. The order will be recorded in the computer registers of Keen on Yoga and will be considered as proof of the contractual relations between the Parties.
In accordance with article 6 below, the Customer has a right of withdrawal and reimbursement, for a period of fourteen (14) working days from the date of receipt of the Products by the Customer.
4.4 Confirmation of the order
An order summary will be displayed once the order is validated.
This confirmation will include all the constituent elements of the contract entered into between the Parties. This order summary will also be sent by email to the Customer within minutes of their purchase.
The Customer will then have access to “follow-up of his order” by clicking on “my account” and identifying himself by his e-mail address and password.
4.5 Gifts and Promotions.
Gift cards for Keen on Yoga service are available for purchase and can be redeemed on our website. The purchase and redemption of gift cards are subject to the gift terms. From time to time, other types of promotional codes may be available, including those provided as part of a third party promotion. Promotional codes may be redeemed as described in the specifics of the promotion. Gift cards and promotional codes cannot be redeemed for cash, and may be combined with other offers, including a free trial, subject to certain restrictions as determined by Keen on Yoga.
ARTICLE 5 – DELIVERY OF PHYSICAL PRODUCTS
5.1 Delivery times and methods
Your orders are processed as quickly as possible. Virtual orders are delivered immediately by automated email on confirmation of payment. Physical orders are prepared upon receipt of payment, payment by credit card guarantees the speed of processing your order.
Delivery time in mainland Europe
For physical items, we aim for shipments to take place within 48 working hours of receipt of payment for your order, unless otherwise indicated on the “cart” page.
After delivery by our Shipping Department, your order is delivered in 5 to 10 days.
These deadlines are understood to be working days, excluding postal delivery problems.
5.2 Delay / lack of delivery
Loss of package during transport
We choose very reliable services, however, it is possible, as in any shipment, that there may be a delay in delivery or that the package gets lost. In the event of a delivery delay of more than 7 days, the Customer must inform Keen on Yoga customer service, which will trigger the opening of an investigation. This investigation can last up to 21 days from its opening. If during this period, the package is found, it will be immediately forwarded to the Customer’s home. If, on the other hand, the package is not found at the end of the 21-day investigation period, we consider the package lost and in this case, Keen on Yoga will send the Customer a replacement package, at our expense.
ARTICLE 6 – RETURN AND RIGHT OF WITHDRAWAL
Conditions of withdrawal
The Customer has a right of return of fourteen (14) days from receipt of the entire order to withdraw without necessarily giving a reason.
To exercise the right of withdrawal, the customer must notify his decision to withdraw his order by a written declaration without ambiguity, specifying his name and surname, e-mail, address, number and date of the order:

In the event of withdrawal from the Customer, Keen on Yoga will reimburse the payments received from the Customer without undue delay and, in any event, no later than fourteen (14) days from the day on which Keen on Yoga is informed of the decision to withdraw.
In the event that the Customer withdraws his entire order, Keen on Yoga will reimburse all payments received from the Customer for this order.
In the event of the Customer’s withdrawal on part of the Products in the order, Keen on Yoga will reimburse the amount of the returned Products.
The refund will be made by the same means of payment as the one that the Customer used for his order or by bank transfer.
Return of physical products
The Customer must return the Products no later than fourteen (14) days after having communicated his decision to withdraw.
Returned products must be unopened, complete and undamaged.
Parcel must be returned to the following address:

ARTICLE 7 – SUBSCRIPTIONS, MEMBERSHIP, FREE TRIALS, BILLING AND CANCELLATION
7.1 Subscriptions and Memberships
Your Keen on Yoga subscription or membership, will automatically renew unless and until you cancel your membership or we terminate it. You must provide us with a current, valid, accepted method of payment (as such may be updated from time to time, “Payment Method”) to use the Keen on Yoga service. We will bill the monthly or yearly membership fee to your Payment Method. You must cancel your membership before it renews each month or each year in order to avoid billing of the next months or next years membership fees to your Payment Method.
We retain the right to modify, terminate or otherwise amend our offered subscription or membership plans.
7.2 Free Trials
Your Keen on Yoga subscription or membership may start with a free trial. For combinations with other offers, restrictions may apply. Free trials are for new subscribers or members only. Keen on Yoga reserves the right to determine your free trial eligibility.
We will begin billing your Payment Method for monthly or yearly membership fees at the end of the free trial period of your subscription or membership and your subscription or membership will automatically renew monthly or yearly at the start of each billing period, as noted in your “Profile” unless you cancel prior to the end of the free trial period.
7.3 Recurring Billing. By starting your Keen on Yoga subscription or membership and providing or designating a Payment Method, you authorize us to charge you a monthly or yearly membership fee at the then current rate.
We automatically bill your Payment Method each month or each year on the calendar day corresponding to the commencement of your paying membership thereafter unless and until you cancel your membership.
We retain the right to change the timing of our billing, if your Payment Method has not successfully settled.
7.5 Cancellation. You may cancel your Keen on Yoga membership at any time, and you will continue to have access to the Keen on Yoga service through the end of your monthly or yearly billing period. We do not provide refunds or credits for any partial-month or partial year membership periods or unwatched Keen on Yoga content nor do we retroact payment. ARTICLE 10 – DISPUTES
This contract is subject to French law. Keen on Yoga cannot be held responsible for any damage of any kind, whether material, immaterial or bodily, which could result from the misuse of the products or services sold.
In the event of difficulties in the application of this contract, the Customer has the possibility, before any legal action, to seek an amicable solution in particular with the help of a professional association of the branch, a consumer association or any other advice of his choice.
Complaints or disputes will always be received with attentive benevolence, good faith being always presumed in those who take the trouble to explain their situation. In the event of a dispute, the Customer will first contact the company to obtain an amicable solution.
In the absence of an amicable agreement between the Parties, the dispute will be submitted to French courts, unless legal provisions to the contrary.

ARTICLE 11 – COMMUNICATION PREFERENCES
By using the Keen on Yoga service, you consent to receiving electronic communications from Keen on Yoga relating to your account. These communications may involve sending emails to your email address provided during registration, and will include notices about your account (e.g., payment authorizations, change in password or Payment Method, confirmation e-mails and other transactional information) and are part of your relationship with Keen on Yoga. You also consent to receiving certain other communications from us, such as newsletters about new Keen on Yoga features and content, special offers, promotional announcements and customer surveys via email or other methods
